The answers in hand before anyone asks.

The $150 Rule

For about ten years the IRS looked at a DPC membership and saw two problems. Both went away on January 1, 2026. This is the HSA change in the order you need it: what changed, what the number means, what to do if you are above it, and the four words to put on your website. Educational, not legal advice.

Remove “HSA-eligible.” Use “We accept HSA cards.”

The December 1 Deadline

If you want to be opted out of Medicare on January 1, 2027, your affidavit needs to be in by about December 1. Three weeks before Christmas, in the middle of open enrollment. Four filing dates a year, who processes it, what to do if you haven’t opted out yet, and why opted out is not excluded.

Thirty-Six Days

Her clinic closed with 36 days’ notice. Her contract said she couldn’t practice within 25 miles for two years. Dr. Nyasha Spears sued for her freedom, opened Amity Creek Primary Care under a judge’s order, and Duluth filled her waiting room.

TRICARE, IHS, and Medicaid

Dr. Katie Burden-Greer on 142 members at 14 months in a town of 800 and the IHS shift that lets her sleep. Dr. Christa Springston on the TRICARE letter that came after the opt-out. Dr. Drew Hertz on an eighteen-month Medicaid contract and whether a plan-paid fee is still DPC.

The Door That Only Opens When a Plan Leaves

A million Medicare Advantage members lose their plan January 1, and their deadline is not December 7. Then how Big Trees MD runs the season: six touchpoints, one tracker, and what went wrong last year.

Who Owns Your Charts

Eleven clauses to find in your EHR agreement before you sign. Data ownership, export, termination, and the lines that decide whether your charts leave with you.

What You Missed at the Illinois DPC Summit

Ten speakers, forty seats, and not one slide. A report from the room.

Name, state, question. That’s all.

The rules that shape a DPC practice differ by state, so the State-by-State series moves state by state and the questions come from you. Selected voicemails play on air and get answered on the episode covering your state.

Why this issue exists

“Last fall, this magazine went to print in the middle of a gray area. HR 1 had passed in July, the IRS hadn’t said what it meant, and I wrote a policy piece that ended on three open questions. This fall is different. It’s the first enrollment season with the HSA rules in hand from day one. We know the number, what the fee has to cover, and what to put on a website. That’s why this issue exists.”

A note on the policy pieces

The $150 Rule and The December 1 Deadline are built from the August State-by-State episode of My DPC Story with Dr. Phil Eskew, DO, JD, MBA. Both are educational, not legal advice. The IRS took public comments on Notice 2026-5 through March 6, 2026, so details may still be refined.
